Minutes - November 9, 2017



A special meeting was called to order at 4:00pm on November 9, 2017 by Mike Winkler, Building Official.

Board Members Present: Jon Tilbert, Jack Harper, Bob Bouwkamp and Gordon Sluiter. Also present were Building Official Mike Winkler; applicant Thomas Martin, HCT building inspector Randy Jarzembowski and Deputy Building Official Dan Radecki.

Winkler explained the reason he has called the meeting to order was that the last elected Chairperson had passed away. No replacement has been appointed at the time of the meeting.

  • It was moved by Bouwkamp and seconded by Harper to elect Tilbert as Chairperson. Motion carried unanimously.

  • It was moved by Harper and seconded by Bouwkamp to approve the agenda. Motion carried unanimously

  • It was moved by Bouwkamp and seconded by Sluiter to elect Harper as Secretary. Motion carried unanimously.

Winkler stated that the township legal counsel has indicated that staff can continue to act as recording secretary and technical advisor at the pleasure of the Board.

The draft copy of the proposed Rules of Procedure for the HCT Construction Board of Appeals that was created and recommended for approval by the HCT legal council was present to the Board by Winkler. The Board took time to review the document, questions were asked and answered.

  • It was moved by Bouwkamp and seconded by Sluiter to adopt the Rules of Procedure for the Holland Charter Township Construction Board of Appeals. Motion carried unanimously.

    There were no inquires, questions or statements by non-Board members.

    There were no minutes to approve as that was done over 2 years ago and no reports.

    There was no old business.


New Business

The Chairperson introduced an appeal by Thomas Martin and declared the public hearing open, and instructed all parties to direct their comments to the Chair.

The appellant made a presentation asking to set aside the Building Officials requirement that he post the occupant load upon completion of his proposed Judes Barber Shop. Winkler then made a presentation of the code basis for his decision to require posting of the occupant load.

  • It was moved by Sluiter and seconded by Harper to close the public hearing. Motion carried unanimously.

The Board then discussed the merits of the appeal without further input from the appellant or the Building Official.

  • It was moved by Sluiter to deny relief to the applicant on the basis that the Building Official had the authority granted in 104.1 of the code to adopt such a policy. Motion died for lack of a second.

  • It was moved by Bouwkamp and seconded by Harper to grant relief to the appellant. Tilbert stated that the policy is in conflict with 1004.3 of the code, which limits posting to assembly buildings, and 104.1 doesn’t allow policies to be created in conflict with other provisions of the code. Motion carried 3-1 with Sluiter opposing.

  • Motion made by Bouwkamp and seconded by Harper to schedule the next meeting of the Board for November 16, 2017 at 5pm for the purpose of approving the minutes and finding of facts for the November 9, 2017 meeting. Motion carried unanimously.

Winkler introduced his retirement on January 5, 2018 and introduced Dan Radecki as the next Building Official.

  • It was moved by Bouwkamp and seconded by Harper to adjourn the meeting. Motion carried unanimously. The meeting adjourned at 5:10 p.m.
